Terms of Service

These terms explain the rules for accessing and using the MochiPay platform.

Important summary

MochiPay provides payment-order, hosted-checkout and blockchain-monitoring software. Cryptocurrency is sent directly to receiving wallets configured for the merchant or platform subscription. We are not a bank, exchange, investment adviser or custodian.

1. Acceptance of These Terms

By registering an account, subscribing to a plan, using an API, installing a plugin or otherwise accessing the Service, you agree to these Terms of Service and the Privacy Policy. If you use the Service for another person or organization, you confirm that you have authority to bind them.

You must be legally able to enter into a binding agreement and must use the Service only where cryptocurrency payment activity is lawful for you and your customers.

2. Description of the Service

The Service helps merchants create payment orders, present cryptocurrency payment instructions, monitor supported blockchain transactions, update order status and send callbacks. Orders may be priced in supported fiat or cryptocurrency, while payment is made using a supported cryptocurrency and network.

The Service does not guarantee settlement, reverse a blockchain transfer, control a public blockchain, provide currency exchange, execute investment trades or resolve disputes between a merchant and customer.

3. Accounts and Security

You must provide accurate registration information and keep your password, API secret, recovery phrase and other credentials confidential. Activity performed through your account or credentials is treated as authorized by you unless you notify us promptly of suspected compromise.

Recovery phrases may control funds. You are responsible for maintaining secure offline backups, verifying wallet addresses and networks, and restricting access to authorized personnel. We cannot recover a lost recovery phrase or reverse a transfer made to an incorrect address or network.

4. Merchant Responsibilities

  • Describe products or services accurately and fulfil customer orders.
  • Use the correct order currency, payment asset, network, amount, callback URL and return URL.
  • Verify payment status through the authenticated API or merchant dashboard before delivering value.
  • Handle refunds, taxes, shipping, consumer rights, sanctions and other legal obligations applicable to your activity.
  • Obtain any notices or consent needed before sending customer information to the Service.
  • Keep API secrets on the server and validate callback data before updating an external order.

5. Cryptocurrency and Blockchain Risks

Cryptocurrency values can change rapidly. Blockchain transactions may be delayed, reorganized, rejected, duplicated in external systems or permanently irreversible. Network fees, congestion, token contracts, wallet software and third-party infrastructure can change without notice.

Displayed exchange rates are reference data used to calculate an order at creation time. They are not investment advice, a guaranteed market quote or a promise that another service will exchange assets at the same rate.

6. Subscription Plans, Pricing and Payments

Subscription plans are priced in USD and paid with an available cryptocurrency shown at checkout. The cryptocurrency amount is calculated using the stored reference rate and applicable configuration at the time the subscription payment is created.

Plan access begins after the required payment is detected and confirmed. Except where required by law or expressly stated otherwise, blockchain payments and subscription charges are non-refundable. A renewal or plan change may create a new payment request.

7. APIs, Plugins and Technical Limits

You may use published APIs and plugins only to integrate your own legitimate payment workflow. You must follow authentication, request-size, rate and field requirements in the current developer documentation.

You may not expose API secrets in browser code, interfere with payment matching, falsify a payment status, bypass access controls, overload the Service, reverse engineer protected components or redistribute a plugin in a misleading or harmful manner.

8. Prohibited Use

You may not use the Service for unlawful activity, fraud, theft, malware, sanctions evasion, deceptive sales, unauthorized financial services, infringement, exploitation, or any activity that could harm users, networks or the Service. We may investigate suspected abuse and restrict access where reasonably necessary.

9. Availability and Changes

The Service is provided on an “as available” basis. Maintenance, network outages, provider failures, software defects or events outside our reasonable control may interrupt operation. We may add, remove or change features, supported assets, networks, limits or documentation.

You are responsible for maintaining your own order records and for designing a reasonable fallback process when automated monitoring or callbacks are unavailable.

10. Disclaimers and Limitation of Liability

To the maximum extent permitted by applicable law, the Service is provided without warranties of uninterrupted operation, merchantability, fitness for a particular purpose or non-infringement. We do not guarantee blockchain confirmation time, exchange-rate accuracy, customer payment, merchant fulfilment or recovery of digital assets.

To the maximum extent permitted by law, MochiPay will not be liable for indirect, incidental, special, consequential or punitive damages, loss of profit, loss of data, lost digital assets, failed transactions or business interruption arising from use of the Service.

You agree to defend and indemnify the Service against claims arising from your products, customers, legal non-compliance, account misuse or breach of these terms.

11. Suspension and Termination

You may stop using the Service at any time. We may suspend or terminate access for a material breach, unlawful use, security risk, unpaid subscription, abuse of infrastructure or conduct that threatens other users. Provisions that by their nature should survive termination will remain effective.

12. General Terms

These terms, together with the Privacy Policy and applicable published plan or API terms, form the agreement for use of the Service. If one provision is unenforceable, the remaining provisions continue in effect. Failure to enforce a provision is not a waiver.

We may update these terms as the Service develops. The effective date will be revised, and continued use after an update means you accept the revised terms where permitted by law.
